Partner Visa / Join Family

The Partner Visa is a visa in Australia that allows the partner or spouse of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. This visa is part of Australia’s family reunion program and aims to reunite couples and families by allowing partners to live together in Australia.

There are several subclasses of Partner Visas, but the two main categories are:

  1. Temporary Partner Visa (subclass 820/309): This visa allows the partner or spouse of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia temporarily. It is the initial stage of the Partner Visa application process. Once granted, the visa holder can live, work, and study in Australia until a decision is made on the permanent Partner Visa application.
  2. Permanent Partner Visa (subclass 801/100): After holding the Temporary Partner Visa for a designated period and meeting the necessary criteria, the visa holder can apply for the Permanent Partner Visa. This visa allows the partner or spouse to live in Australia permanently. It provides access to healthcare, social security benefits, and the opportunity to apply for Australian citizenship, among other benefits.

Australia recognizes any of the following relationships:

De Facto

Relationships with 12 months duration being registered in a notary’s office or not. Registered relationship is Australian Notary Public (KW), there is no need to wait for 12 months of relationship to carry out visa application.

MARRIAGE

For couples who have officialized the marriage, whether in Australia or in another country. The marriage must be recognized by the Australian Government (KW).

FIANCE

For couples who are engaged and planning to get married in Australia. Applicant must be outside Australia at the time of application and decision. This visa is valid for 9 months, and after the wedding, you can proceed with the Partner (marriage) visa.

New Zealander Partner

Temporary residency with the support of an Australian state or Territory or an eligible family member. Possible pathway to permanent residency.

Generally, approved de facto and marriage applications will receive an initial temporary visa, that can lead to permanent residence after two years of the initial visa application has been submitted.
 
Long term relationships (KW) of three years or more may apply for permanent residence directly.
 
Approved fiancé applications will be valid for nine months; during this period, it is essential to get married to proceed with the visa application as a married couple.
